The Public Utilities Regulatory Authority is in receipt of your most recent consumer affairs inquiry regarding Frontier’s provision of service to your premises. Although the Authority is unable to provide informal legal opinions or advice, the Authority has reviewed the portion of Frontier’s tariff that you cited for the premise that Frontier is obligated to cover the costs of constructing service to your premises (Section 16, Original Sheet 5). The Authority notes that there are also other relevant sections of the tariff that may apply here, which could require a customer to pay the costs of construction (see e.g. highlighted portions of Section 16, Sheet 1 on page 137 of the attached document).
As noted above, the Authority cannot give an informal interpretation of Frontier’s obligations in this context. If, upon reviewing the attached tariff, you would like a formal determination regarding whether Frontier is obligated to provide the requested service, and, if so, who is required to bear the construction costs associated with providing service to the premises, you may present your case, including your positions on the facts and law, in writing and request a Declaratory Ruling from the Authority. (See Connecticut General Statutes 4-176 for more information on declaratory rulings). If you choose to seek a Declaratory Ruling, you can find information on PURA’s website about how to register for and make filings using the web-filing system.
